Privacy Policy

1. INTRODUCTION
This website, www.icdt.hu (the ‘Site’), is owned and operated by the International Centre for Democratic Transition (ICDT). For more information about our organization please see About The ICDT.
We are committed to safeguarding the privacy of users of the Site. Please read the following Privacy Policy to understand how we use and protect the information that you provide. If you have any queries or concerns regarding these practices, please contact us by e-mailing newsletter@icdt.hu.
Please note that by visiting and using the Site you are agreeing to the use of your personal information as described in this Privacy Policy.

2. THE INFORMATION WE COLLECT AND HOW WE USE IT
We collect personal information from you when you:
- Sign up to our newsletter
If you register on the Site to receive the ICDT's bi-monthly newsletter, we collect personal information such as your name, country and e-mail address.
We use this information to send you your requested newsletter, email alerts on new publications and other information on the ICDT such as details of special events. We use this information to assess the use of our newsletter by different countries and different types of users. We also use this information to drive our communications program.
- Provide us with feedback
If you provide feedback to us, whether by using the Contact Form or otherwise, we collect any personal information that you disclose to us.
We use this information to improve the Site and the services we offer.

3. INFORMATION SHARING AND DISCLOSURE
We do not sell or rent your personal information. We may, however, give information about you to the following, for the express purposes set out below:
if you sign up to our newsletter
- to our employees and agents for them to send you your bi-monthly newsletter;
- to our employees and agents for them to provide you with information on publications and events
- if ownership or operational control of all or part of the Site is transferred, for whatever reason, we may disclose your personal information to the transferee. In this event, we would require them to use your information in a way that is consistent with this Privacy Policy.
If we do give your information to the third parties set out above, we will always require they adhere to the same security procedures that we follow ourselves.

4. LEGAL REQUESTS
We may need to disclose personal information to protect our and our licensors’ rights and property or to comply with any applicable law or valid legal process.

5. AGGREGATED INFORMATION
We may share non-personal aggregated statistics data about visitors to the Site and traffic patterns with our partners and other third parties. Just to be clear, this information does not identify users in any personal capacity; it just gives generalized information about the users of the Site.

6. LINKS
The Site contains links to third party websites that are not subject to this Privacy Policy. We strongly recommend that you read the privacy policy of any such websites that you visit.

7. SECURITY
7.1. As required by Hungarian Data Protection laws, we follow strict security procedures in the storage and disclosure of information which you have given to us, to prevent unauthorized access. In particular, we use Secure Sockets Layer (SSL) to encode your personal information. SSL encrypts your contact details and your password as it travels through the Internet. Encryption creates billions of code combinations to protect each transaction made on the website, so your details cannot be viewed by anyone else using the internet.
7.2. Despite using this technology, we cannot guarantee the security of the information that you disclose to us. You accept the inherent risks of providing information and dealing on-line and will not hold us responsible for any breach of security unless this is due to our negligence or willful default.

8. UPDATING REGISTRATION INFORMATION
If your email address has changed and you would like to continue to receive the bi-monthly newsletter, please go to the Sign Up area of the Site and follow the link to Register a New Email Address. If you would like to change any other registration details you provided when you signed up to receive the newsletter, you can email newsletter@icdt.hu.

9. RIGHT TO SEE YOUR INFORMATION
You have the right to obtain a copy of the personal information that we hold about you, whether collected through your use of this Site or through any communications that you have had with us. You will need to provide us with a written signed request (e-mails are not accepted). We will provide this information free of charge for one request per calendar year. If you require more frequent copies of your information, we reserve the right to charge a reasonable administrative fee to cover our costs for providing this information. If you have any queries about your right or wish to make such a request, please contact us by post addressed to the Chief Communications Officer, International Centre for Democratic Transition, Árvácska u. 12., 1022 Budapest, Hungary and we will do our best to resolve these within a reasonable time.

10. POLICY CHANGES
We may change this Privacy Policy at any time by sending you an e-mail with the modified Privacy Policy or by posting a copy of them on the Site. Any changes will take effect seven (7) days after the date of our e-mail or the date on which we post the modified policy on the Site, whichever is the earlier. Your continued use of the Site after that period expires means that you agree to be bound by the modified Privacy Policy.

Welcome to www.icdt.hu  (the ‘Site’), which is owned and operated by the International Centre for Democratic Transition (ICDT). ICDT is a non-governmental, non-profit organization. For more information on our organization, please see About the ICDT.

2. THESE TERMS
These are the Terms of Use (‘Terms’) that apply to your use of the Site. By using the Site, regardless of whether or not you choose to register, you are agreeing to be bound by these Terms. If you do not wish to be bound by what you read below, you should not use the Site.

3. CHANGES TO THESE TERMS
We may change these Terms at any time by sending you an e-mail with the modified Terms or by posting a copy of them on the Site. Any changes will take effect seven (7) days after the date of our e-mail or the date on which we post the modified Terms on the Site, whichever is the earlier. 4. ACCESS AND REGISTRATION
4.1. You are free to browse the Site without registering. However, if you want to download any of our publications or sign up to receive newsletters then you will need to register.
4.2. Each registration is for a single user only. Please do not share your registration details with any other person as you will be held responsible for all activities that occur under your password or account with or without your knowledge.

5. INTELLECTUAL PROPERTY
5.1 All publications are available for use on the basis described in Our Publications. However, all other content on the Site, including software, graphics, photographs and text, is owned by us or our licensors. You acknowledge that all copyright, trademarks and all other intellectual property rights in the Site and in the publications made available via it, shall at all times remain vested in us or our licensors. You are allowed to use such content for personal, non-commercial use for the purpose of viewing our Site and making use of our content in accordance with these Terms only. Any rights not expressly granted in these Terms are reserved.
5.2 The trade mark “ICDT” is owned by us. All other brand names and trademarks that appear on the Site are trademarks or trade names of their respective holders. No permission is given in respect of the use of any of these brands or marks, (other than is provided for in clause 12.1), and any such use may constitute an infringement of the holder’s rights.

6. OUR PUBLICATIONS
6.1 All our publications are available for download in electronic format free of charge and you are free to:
6.1.1 use the text of the publication only, but not any images, graphics or logos included in the publication,
provided that
6.1.2 you only make non-commercial use of the text;
6.1.3 you agree that any intellectual property rights arising out of your use of the text will belong to us and you will do anything that we reasonably request to give effect to this provision;
6.1.4 you agree that we are entitled to alter, amend and otherwise modify, and to license and assign any work that arises out of your use of the text;
6.1.5 you credit the original author;
6.1.6 you do not use the text in any way which is likely to reflect negatively on the ICDT;
6.1.7 if you make the text available on the internet, you display a hyperlink from the website hosting the text to our Site;
6.1.8 if you publish the text or a substantial part of it in print, you send us 2 copies of that publication to the ICDT's office together with an electronic file in PDF format that we can make available on our Site; and
6.1.9 you acknowledge the ICDT's copyright on any use that you make of the text as follows:
“International Centre for Democratic Transition (ICDT), Budapest, Hungary, [insert year]. copyright © International Centre for Democratic Transition.”
6.2 If you want to translate the text, then in addition to the above terms:
6.2.1 You will not change or edit the meaning of the original text.
6.2.2 If you engage any third party to translate the text or any part of it, you will acquire any rights they have acquired in the translation to you and you will procure that they waive the benefit of any moral rights or any similar rights that they may have in the translation.
6.2.3 You will include on the copyright page of the translation the following statement:
“This is a direct translation of the [insert year] of International Centre for Democratic Transition's [insert title]. The accuracy of the translated text was not verified by the ICDT. In case of doubt, the original English/Hungarian version prevails [insert ISBN of original version]. This translation was undertaken by [insert the full name and address of your organization].”
6.3 The above license is personal to you and non-transferable.
6.4 PLEASE NOTE that if you use any of the publications in a way other than is specifically permitted under these Terms, you may be infringing copyright and therefore may be exposed to civil and/or criminal legal action.

7. INDEMNITY
You agree to indemnify, defend and hold harmless us, our directors, officers, employees and licensors from and against any claim, liability, cost, damage or loss we may incur (including reasonable legal fees) as a result of any actions you take which disrupt access to and/or functioning of the Site and/or any breach by you of your obligations under these Terms, including but not limited to any breach by you of the CC license terms and/or our standard licensing terms.

8. THIRD PARTY SOFTWARE
8.1 You acknowledge that you might need to download and activate certain third party software in order to download, view and use the content in electronic format provided on the Site (e.g. Adobe Reader). This software will be clearly identified on the Site.
8.2 In order to use such third party software or technology you may have to explicitly accept the terms of a license agreement with that third party. You acknowledge that we have no responsibility or control over such third party software.

9. PRIVACY POLICY
We take your privacy seriously. Please read our Privacy Policy to see what personal information we collect and how we deal with this information.

10. LINKS FROM THIS SITE
The Site may include links to third party websites. We have not reviewed these third party websites and do not control and are not responsible for these websites or their content or availability. We therefore do not endorse or make any representations about them, or any material found there, or any results that may be obtained from using them. If you decide to access any of the third party websites linked to the Site, you do so entirely at your own risk.

You are welcome to link to our Site if you comply with the terms set out in this section and all applicable laws. Any site or service that links to our Site:
may link to any page on the Site, provided that you do not link directly to any publication in electronic format made available on the Site;
must not in any way imply that we are endorsing it or its products or services;
must not misrepresent its relationship with us or present false information about us;

12. USER CONDUCT
We positively encourage your use of the knowledge resources and information on the Site. However, we do require that your use of the Site is lawful. Consequently, you may not use the Site for any illegal purpose and in particular you will not interfere with or disrupt the Site or servers or networks connected to the Site, or disobey any requirements, procedures, policies or regulations of networks connected to the Site.

13. LIMITATIONS AND DISCLAIMERS
13.1 We promise that we will operate the Site with reasonable skill and care and that we will use our reasonable endeavors to correct any faults of which we are aware. However, although we provide the Site in good faith we cannot and do not guarantee the accuracy, integrity, quality or completeness of the knowledge resources, information or other content found on our Site, or their usefulness for any particular purpose.
13.2 We also promise that we have permission from the original rights owners to allow you to use the publications that are made available from or via the Site, in accordance with the relevant terms set out in Our Publications.
13.3 We do not promise that your access to the Site, or its content (including the electronic publications) will be delivered uninterrupted, timely or error-free, or that the Site will be free from viruses or other harmful properties. Any material downloaded or otherwise obtained through the use of the Site is done at your own risk and you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.
13.4 Occasionally we are unable to perform our obligations under these Terms due to circumstances beyond our reasonable control. In such circumstances including, but not limited to, system failure, fire, flood, earthquake and other natural physical disasters, strikes, trade disputes, lock outs, riot, accident, disruption to energy supplies, civil commotion, acts of terrorism or war, our inability or delay in performing our obligations will not be deemed to be in breach of contract.

14. RIGHTS AND REMEDIES
14.1 Nothing in these Terms will restrict our liability for death or personal injury resulting from our negligence.
14.2 You agree that, to the extent permitted by law, we will not be held liable for any direct, indirect, incidental or other type loss or injury resulting from your downloading or use of any content (including electronic publications) from the Site.

15. GENERAL
Severability
15.1 If any of these provisions is deemed invalid, void or unenforceable that provision will be deemed severable from the rest and will not affect the validity and enforceability of any remaining provisions.
Entire Agreement
15.2 These Terms govern our relationship with you and represent our entire agreement with you. Assignment
15.3 You may not assign, sub-license or otherwise transfer any of your rights under these Terms.
Waiver
15.4 If you breach these Terms and we choose to ignore your breach, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach the Terms again.
Exclusion of Third Party Rights
15.5 These Terms do not create any right enforceable by any person who is not a party to this Agreement.
Governing Law and Jurisdiction
15.6 These Terms shall be governed by the laws of Hungary.
Dispute Resolution
15.7 Any dispute, controversy, or claim which cannot be settled amicably shall be submitted to and finally settled by arbitration in the following manner:
15.7.1 The arbitration shall be held in accordance with the metropolitan court.
15.7.2 The decision of the arbitrator shall be final and binding on the Parties.
15.7.3 The place of arbitration shall be determined the metropolitan court.
15.7.4 The English language shall be the official language to be used in the arbitral proceedings and for all purposes related to arbitration.
